Booking. . . your sojourn without surprices.

1. GENERAL CONDITIONS: "Magicasa" is an Italian Real Estate Agency also dealing with different kinds of holiday rentals, available on our web-site with descriptions and pictures. The rental conditions are set down by the owner of the property or his representative.
2. Booking: All bookings are subject to our written confirmation. More details concerning the property description can be requested by mailing to magicasa@lunigiana.it , by writing to: Magicasa - Viale della Resistenza,6 - 54011 Aulla (MS) - Italy or by phoning to the following number: +39 0187 421569; fax +39 0187 424635.
3. Prices: The prices quoted are per week and living unit, NOT per person. The price covers the use of the living unit, the furnishings, the kitchen utensils and all accessories necessary for a short stay. The cost of utilities such as electricity, gas and water are NOT included in the price (unless expressly stated otherwise). Bed and table linen as well as towels are included. The cost for final cleaning of the unit is always extra and runs between €. 30,00 and €. 60,00 (except for particular and special situations).
4. Payment and Deposit:After receiving our written confirmation a deposit of 25% of the total rental sum is due within 7 (seven) days. The balance is due 45 (forty-five) days before begin of the rental period. The confirmation by "Magicasa" looses its validity should this sum not be paid within the required time limits. "Magicasa is free to dispose of the property to its own discretion. If bookings are made later than 45 (forty-five) days before arrival the full rental sum is due no later than 48 (forty-eight) hours after receiving of our written confirmation. The holidaymaker will receive all necessary travel information, documents (address and map of how to get there), and instructions for the handover of house keys, only AFTER payment has been received.
5. Our Service: "Magicasa" has visited and checked each property. The descriptions appearing on our website are accurate and have been prepared in good faith. Please note that the binding price is the one indicated on your booking confirmation. Any additional agreements must have been agreed, confirmed and written down by "Magicasa". The rental price does not include extra costs listed (such as final cleaning, utilities, etc.). Please remember that all properties chosen and rented by "Magicasa" reflect, in their architecture and furnishing, the local traditions and personal taste of the owner.
6. Alterations - Cancellation charges:In case of a booking cancellation, even if substituted by someone else, the following penalties must be paid: 15% of the rental price if the cancellation is made at least 75 days before the start of the rental period; 25% of the rental price if cancellation is made between 74 and 43 days before the start of the rental period; 50% of the rental price if cancellation is made between 42 and 30 days before the start of the rental period; 90% of the rental price if cancellation is made during the 29 days before the day of the starting of rental period.
7. Minimum Rental:The minimum rental period is a week, from Saturday to Saturday. During July and August bookings must be for a minimum period of two weeks!
8. Arrival & Departure:Arrival day is Saturday between 3:00p.m and 7:00p.m , and departure between 8:00a.m and 10:00a.m. Any change of arrival or departure time must be communicated to and confirmed by "Magicasa" at least 3 (three) days before arrival. In case of unavoidable delay on the Saturday of arrival, please call our customer care service: +39.333.3532763. Magicasa declines any responsibility in the event that the owner is not available when the holiday maker has failed to arrive within the time stipulated without giving notice of it. Passport or identity card must be given immediately to the owner to enable him to proceed with the registration of the persons to the authorities according to Italian legal requirements.(ONLY the number of persons stipulated on the booking form and whose presence has been registered may use the property). The number of persons (adults and children) must NOT exceed the number of sleeping places indicated in the property description. In case of infants you will have to provide yourselves to bring a travel cot. Infants and children up to three years are not calculated. Animals are not allowed unless expressly indicated in the property description or agreed upon in advance with "Magicasa".
9. Security Deposit:At the moment of handling over of the key a security deposit to guarantee of minimum 200 Euro must be paid by the holiday maker to the owner or his representative. The amount will be refunded at the end of the stay unless any damage has been caused to the property. The owner or his representative can REFUSE ACCESS to the property if the security deposit is not handed over. Should the holiday maker leave earlier, the owner is authorized to to refund the deposit by mail (unless there have been damages) and only after having checked the inventory and property condition. "Magicasa" declines all responsibility concerning any dispute between the holiday maker and the owner regarding the deposit.
10. Responsibility:Should problems arise during the stay, these must be communicated immediately. The owner or his representative must have the possibility to check and eventually eliminate the problem. If this is not possible, the holiday maker must contact the customer service of "Magicasa" on the Saturday evening of his arrival. The holiday maker is obliged to give the owner, or "Magicasa" the time to solve the problem. In case of problems the holiday maker undertakes to do his best to minimize them in order to avoid any prejudices that might result. Holiday makers who leave the property in advance without notifying any problem, forfeit the right of refund of rental price, unless there is a legal right for them to have cancelled. Complaints made at the end of the stay will not be taken into consideration and no refunds will be made. Any liability for problems in electricity or water supply due to major force are excluded, as well as liability for perfect functioning of heating, air-conditioning, elevators or swimming pools. "Magicasa" declines any liability for changes made by the owner without having received notice of it.
11. Cleaning, Maintenance and Heating:The property will be handed over clean, tidy and in good conditions. The holiday maker has to pay the owner for the final cleaning (see prices). This amount does not however include the cleaning of kitchen/kitchenette such as dirty dishes, removal of rubbish, etc. If this is not done, the owner has the right to charge extra for these services. As concerns the energy supply this is subjected to the current laws in force in Italy; the heating is controlled by regulations that vary from region to region. In many regions heating may be turned on between November and April. The rented property and its furnishings must be treated with care, should damages occur during the stay, these have to be notified to the owner or his representative as soon as possible, and in some cases replaced. The renter is responsible for all the people, children and animals accompanying him.
12. Court of Law:In case of controversies arising from booking or renting, the Court of Law of Massa or Pontremoli is competent to judge, and only the Italian Law will be applicable. Signing the booking implies that Magicasa's General Conditions of Rental have been understood and accepted without reserve or exception.
